Inspection Policy

This policy explains your rights and duties when submitting a request for inspection of a listed item on MedWOW, or when a request was submitted to inspect an item that you have listed on MedWOW. The inspection process is subject to MedWOW's User Agreement(the "User Agreement") and to this policy.

This policy is incorporated to the User Agreement. By accepting the User Agreement, you agree to be bound by the terms of this policy, as well.

 

Inspection types

MedWOW provides 5 different types of inspection:

- Standard inspection while operating – Performing standard inspections on an operating device, before buying, according to standard specifications.

- Standard inspection while packed – Performing standard inspections on a packed device, before buying, according to standard specifications.

- Special Inspection – Performing special inspections, before buying, according to buyer specifications.

- Dismantling supervision – While dismantling a device it is important to arrange all sub-systems according to manufacturer specifications and not to miss any part/item.

- Packing supervision – Making sure the packing phase meets original manufacturer specification, and is done with the utmost care.

A specific form has been created for each type of inspection (besides Special Inspection). This form includes all stages of necessary inspection and specification, and is designed especially for each specific device.

Note, that any item or part not specifically detailed in the inspection request, whether standard or special, will not be inspected, and MedWOW will not be responsible for any fault in said part or item.

Submitting a request for inspection

If user lists an item for sale on MedWOW, or wishes to purchase a listed item, then user may request to submit an item for professional inspection. MedWOW will perform the inspection by using specialists on its behalf.

The inspections will be performed prior to the item's purchase, or while dismantling the item and/or preparing it for shipment, at user's request.

Following users submission of request for inspection, MedWOW will contact a suitable specialist, in the closest proximity to the seller's location as MedWOW may find. After filling in the necessary details in the inspection form, accepting MedWOW's user agreement, and paying the inspection costs, the specialist will perform a standard or special inspection, as requested and indicated in users request.

User may refer questions to the inspection specialist through MedWOW, at the end of the inspection phase.

Following the completion of the inspection, MedWOW will send user a copy of the inspection results.

MedWOW retain all rights, title and interest in and to any and all inspection files, documents and results, and are free to introduce them to third parties, sell them and make any further use with them, at MedWOW's sole discretion.

Note, that in case results of a standard or special inspection, as requested and indicated in user's request, already exist in MedWOW's files, MedWOW may, at its sole discretion, refrain from performing a new inspection, and send user a copy of the existing inspection.

The Inspection Period

By listing an item for sale on MedWOW and agreeing that user's item will be inspected, user agrees to submit the item for inspection and to cease all attempts to sell the item, or change the conditions of sale and information pertaining to the item, if a buyer submitted a request for inspection of that item and paid inspection costs ("the Inspection Period"). The Inspection Period shall last until 4 days after the buyer received the inspection results.

However, submitting a request for inspection of an item listed under an auction sale does not stop the auction process, or prevent other bidders from purchasing the inspected item.

If the buyer accepts the seller's offer within the Inspection Period, then the seller must sell the item to the buyer, at the price and conditions of sale that were indicated by the seller on MedWOW prior to the initiation of the Inspection Period. If the buyer does not agree to buy the item at the offered price and conditions of sale within the Inspection Period, or fails to respond within the Inspection Period, than the seller will be free to engage with other potential buyers to sell the item and change the price and conditions of sale pertaining to the item, upon termination of the Inspection Period.

 

Inspection costs

By submitting a request for inspection, user agrees to pay inspection cost in accordance with the specific inspection quotationand acknowledge that only after payment of the inspection cost will the seller be compelled to cease all attempts to sell the item, and refrain from changing the conditions of sale and information pertaining to the item.

 

LIMITATION OF LIABILITY

NOTWITHSTANDING THE PROVISIONS OF THE USER AGREEMENT, WE, INCLUDING OUR OFFICERS, DIRECTORS, SHAREHOLDERS, EMPLOYEES, SUB-CONTRACTORS AND AGENTS SHALL NOT BE LIABLE, TO THE MAXIMUM EXTENT PERMITTED BY THE APPLICABLE LAW, FOR ANY INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGE, OR ANY OTHER DAMAGE, AND LOSS (INCLUDING LOSS OF PROFIT AND LOSS OF DATA), COSTS, EXPENSES AND PAYMENTS, EITHER IN TORT, CONTRACTUAL, OR IN ANY OTHER FORM OF LIABILITY, ARISING FROM, OR IN CONNECTION WITH THE INSPECTION PROCESS AND RESAULTS. IN ANY EVENT, YOUR SOLE REMEDY FOR ANY DIRECT DAMAGE, OR LOSS, ARISING FROM, OR IN CONNECTION WITH THE INSPECTION PROCESS AND RESAULTS, SHALL NOT EXCEED THE INSPECTION COSTS.

Changes to this Policy

We may change and update the terms of this Policy from time to time. We therefore recommend that you read it periodically. All substantial changes that we make to this Policy will be notified on MedWOW and take effect 30 days following their initial posting.
